A Pennsylvania judge has ruled that America PAC, the political action committee run by Elon Musk, can continue its $1 million-a-day giveaway, a program previously under fire for allegedly functioning as an illegal lottery. Pennsylvania Attorney General Larry Krasner, who filed suit to block the initiative, argued that the daily prize appeared to be a random drawing, violating laws on lotteries and potentially infringing on election laws. However, the court was convinced that the America PAC giveaway does not qualify as a lottery because it predetermines its recipients, aligning more with a paid spokesperson model than a sweepstakes.

Pre-Determined Winners, Not a Lottery

America PAC, a pro-Trump organization, has been offering $1 million daily to select individuals from key battleground states, including Pennsylvania, Michigan, and Arizona. While initially portrayed by Musk as a “random” prize, America PAC’s attorney, Chris Gober, clarified in court that winners are actually preselected based on their alignment with America PAC’s values and suitability as spokespeople for its pro-Trump agenda.

“We know exactly who will be announced as the $1 million recipient today and tomorrow,” Gober stated during the hearing. This approach contrasts with lottery dynamics, where winners are chosen by chance. Judge Angelo Foglietta sided with the PAC, allowing the program to continue, although he withheld immediate reasons for his ruling, which will be detailed in a forthcoming explanation.

The controversy arose from Musk’s public statements, where he appeared to present the giveaway as a randomized incentive for voters to sign a petition supporting free speech and Second Amendment rights. Krasner’s office argued that paying individuals to sign a petition, especially under the impression of a random draw, strays into murky legal waters, especially around election laws that prohibit financial incentives tied to voter registration. Federal laws similarly restrict these types of offers.

America PAC: Pro-Trump Push with Big Financial Backing

Elon Musk’s financial commitment to America PAC is substantial, with nearly $120 million directed toward voter mobilization and registration efforts aimed at swing states crucial for Trump’s campaign. Pennsylvania’s 19 electoral votes, among others in swing states like Georgia and Michigan, are likely to play a pivotal role in the upcoming election. America PAC’s daily giveaway, which launched on October 19, has already distributed $16 million to date, fueling a contentious political landscape as Election Day approaches.

America PAC Director Chris Young explained in court that recipients are carefully selected, not only based on petition signatures but through a screening process. Young noted that this alignment process is central to the PAC’s goal of building spokespeople for its cause, not random prize winners.

The case has highlighted tensions around election law interpretation. Krasner’s team argued that Musk’s initial description of the giveaway as random borders on deceptive, presenting it as one of the “greatest scams” of the past fifty years. However, Musk’s legal team rebutted these claims, asserting that America PAC has remained transparent about its selection criteria and that the funds are more accurately characterized as compensation for spokesperson duties rather than a lottery prize.

Interestingly, America PAC requires recipients to sign non-disclosure agreements (NDAs), which prohibit them from discussing the specific terms of their contracts publicly. This layer of confidentiality, combined with the PAC’s careful selection process, contributes to its strategy of shaping a curated group of voices that resonate with Musk’s pro-Trump messaging.

The U.S. Department of Justice previously issued a warning to Musk, signaling that America PAC’s giveaway could still face federal scrutiny, though federal prosecutors have not taken further action.
