Biden Admin Suing Texas For Being Pro-Life. What’s Next?

The Biden administration plans to sue the state of Texas due to the state’s ban on abortions beyond six weeks.

Per a Wall Street Journal report, the Department of Justice could file a lawsuit against the state as soon as Thursday. The report said that this schedule could also be pushed back.

Supreme Court Decide Against a Stay for Texas Law

According to a Daily Wire report about a related Supreme Court ruling, this revelation comes a day after the law banning abortion in Texas in most cases went into effect on Wednesday. The legislation prohibits abortion in almost every case following the detection of heart activity in the unborn child. The court’s decision provides a stepping stone for the pro-life movement to reach a historic win by overturning precedents set in Planned Parenthood v. Casey (1992) and by Roe v. Wade (1973), per the Washington Free Beacon.

Texas is not alone in enacting such a law. However, the state’s case has become the first that avoided a stay that prevents the law from taking effect. With a narrow decision, the Supreme Court went against granting relief to several abortion providers.

Not long after the said court declined a stay, President Joe Biden released a furious response. It should be noted that he did so much faster than making his decision to help the Americans that are still stranded in Afghanistan.

In a statement, Biden revealed that he is instructing the Council and the Office of the White House Counsel to pursue a “whole-of-government effort” as a response to the decision. He said he may look specifically to the Health and Human Services Department and the Justice Department to find ways that the Federal Government can take to make sure Texas women will still have access to “safe and legal abortions” that are protected by the 1973 precedent. He also wants these government departments to find legal tools that they can use to “insulate women and providers” from the effects of Texas’ new policy.

The Democrat members of the House Judiciary Committee also felt upset about the fact that Texas would now ban the killing of unborn babies in the states.

They described the ban as a “clear violation” of a female’s right to opt for abortion before the fetus is viable. The group also said they object to the legislation’s provision, allowing private citizens to sue entities who help in “the performance or inducement of an abortion.”

They described the law’s “private right of action” as its “most insidious feature.” According to the Democrats, it shows Texas’ efforts to have enough time to sidestep judicial scrutiny so that a “clearly unconstitutional” law can be enacted.

The group ended their statement by describing the new system provided by the law as “perverse,” hypocritically saying that it is “just plain chilling.”
