Breaking: Biden Administration Forces Federal Judge to Block Texas ‘Abortion Law’
A federal judge has ordered to suspend the Texas Heartbeat Act, which effectively barred the majority of abortions in the state since last month.
U.S. District Judge Robert Pitman ordered Texas to stop enforcing the law temporarily, per an AP report. The report added that, even if the law was suspended, Texas abortion services could likely not resume immediately as doctors are afraid that people coils sue them if the legal decision isn’t more permanent.
Given this, Texas officials will likely look for the suspension’s quick reversal from the 5th. U.S. Circuit Court of Appeals. The said court previously let these restrictions take effect.
The Department of Justice argued that the Texas law needs to be suspended while the case is being heard due to its significant impact on women, as it forces many to drive to other states just to seek reproductive care if they have the resources to do so.
According to Bloomberg, Pitman didn’t hold back in his ruling, describing the Heartbeat Act as “contrived” to dodge a person’s constitutional right. He then denied the state’s request to trash the Justice Department’s challenge to the said legislation.
“A person’s right under the Constitution to choose to obtain an abortion prior to fetal viability is well established,” Pitman, an Obama appointee, said. “Fully aware that depriving its citizens of this right by direct state action would be flagrantly unconstitutional, the State contrived an unprecedented and transparent statutory scheme to do just that,” he added.
