The Supreme Court has had a vacancy since Justice Scalia's death last year. Part of the holdup is that the Democrats may attempt to filibuster the confirmation of President Trump's nominee, Neil Gorsuch. So why hasn't Mitch McConnell shut the filibuster down?

The filibuster is a favorite tool for Democrats when they aren't in the majority. The same party that hates it when the Republicans force a shutdown of nonessential government services as a way of calling attention to our growing national debt will basically perform the Senate version of a “denial of service” attack that bogs down Congress unless they get their way. Unless the Republicans stand up to them by shutting down the filibuster, Gorsuch will have to have the patience of a saint.

The Democrats will have to play their cards right if they want to have a chance of regaining the majority in the Senate in 2018. Their current plans include the implication that President Trump's nominee to the Supreme Court is sexist, based on comments made by Democratic Illinois senator Dick Durbin.

Obviously this is not necessarily true if one looks at Gorsuch's actual record on court rulings, but this is not an uncommon tactic for Democrats who are afraid that their goals of open borders, globalism and extreme “tolerance” will be derailed by a 5-4 conservative majority in the Supreme Court.

In the meantime, Republicans can take advantage of their ability to change the rules for shutting down the filibuster. It's not like there wouldn't be precedent for moving the bar for what it takes to break up the filibuster.

When the Democrats didn't like how easy it was to end a debate, they changed the requirement from a simple majority to a 2/3 supermajority in 1917. Following these new rules, a vote to end the debate – known as “cloture” – was successful only five times in 45 years.Then when it got too difficult to break up a Republican filibuster, the Democrats scaled the requirement back to 60 votes in 1962.

So when voters hear their implications that the Republicans want to move the bar to make it easier for Gorsuch's nomination to move forward, they should keep in mind that the Democrats also have a history of changing the rules to suit  their purposes.

Voters Should Encourage Their Senators To Use “The Nuclear Option”

If successful, this campaign will trigger a nuclear option in which Democrat plans to filibuster the confirmation of Gorsuch is shut down before it can get very far. This will speed up Gorsuch's nomination and spare him from having to cool his heels until the Democrats have exhausted themselves with their filibuster. This will also free up Congress to focus on other important matters such as going back to the drawing board with repealing and replacing Obamacare and reforming the tax code.

Republicans probably want to do this anyway, but should be encouraged by hearing from real voters that this is what their constituents want. The message that senators should hear is that voters want that vacancy to be filled and they want to know that the person who is going to be sitting in the seat that Justice Scalia vacated cares about interpreting the Constitution in the way that the original Founding Fathers would have if we could travel through time and ask them directly.

That means shutting down Democratic efforts to derail the process by filibustering Gorsuch's nomination. According to rules that the Democrats themselves put in place, shutting down the debate takes sixty votes and Republicans can change that so that the confirmation vote can move forward.
