President Donald Trump’s official online store is now selling a bold new piece of merchandise: a red “Trump 2028” hat. Made in America and priced at $50, the cap mimics the iconic MAGA design but swaps in a year that has sparked legal debate. While the product rollout electrifies Trump’s base and trolls his critics, it also reignites discussion over his repeated hints that he could seek a third presidential term.
The President first floated the idea of Trump 2028 earlier this year during an NBC News interview, where he insisted he was “not joking” about running again and claimed there are “methods” that could make it happen. In one scenario, he proposed running as a vice-presidential candidate with J.D. Vance at the top of the ticket, implying that he could still return to the Oval Office through a loophole. But when pressed about the idea during a follow-up interview aboard Air Force One, Trump dodged specifics and suggested the public simply “wants” him to stay in office longer.
The release of the Trump 2028 hat has intensified those signals. Photos of Eric Trump wearing the new merchandise circulated on social media, while the Trump campaign’s online store encouraged supporters to “make a statement” by wearing it. Alongside the hats, shirts bearing the same slogan and phrases like “Rewrite the Rules” have also gone up for sale. To Trump’s detractors, this is more than merchandise, it’s a political message hinting at intentions that may go beyond the legal limits of the presidency.
Why a Third Term Would Be Nearly Impossible Without Constitutional Change
As Trump teases the idea of running in 2028, the 22nd Amendment stands firmly in the way. Passed in 1951, the amendment was a direct response to Franklin D. Roosevelt’s unprecedented four-term presidency. It clearly states: “No person shall be elected to the office of the President more than twice.” Trump’s terms from 2017 to 2021 and 2025 to 2029 would complete his constitutional limit.
Legal scholars agree that any path toward Trump 2028 would require changing the Constitution itself, which is an enormous challenge. Amending the Constitution demands a two-thirds vote in both the House and the Senate, followed by ratification from three-fourths of U.S. states. This isn’t just unlikely, it’s nearly unimaginable given the current political climate.
Even alternative theories, such as Trump running as vice president and ascending again to the presidency, remain legally murky at best. The idea would undoubtedly face immediate court challenges and would likely be struck down as a violation of both the 22nd and 12th Amendments. The latter prevents a person ineligible for the presidency from being elected vice president.
Despite these legal hurdles, some Trump allies appear serious. Former adviser Steve Bannon said earlier this year that the campaign is “working on it,” while Rep. Andy Ogles introduced a symbolic measure to allow Trump and no other former president to seek a third term. These moves have been dismissed as “too fanciful” by some Republicans and legal experts, but they still reflect the unique political moment Trump continues to shape.
Ultimately, the Trump 2028 campaign gear may be more about stoking enthusiasm and outrage than pursuing legal action. It’s a calculated move that helps the president remain in the headlines and rally his base while dancing along the edge of constitutional boundaries. For now, Trump can sell the idea. But under the law, he can’t sell a third term to American voters—at least not yet.

No I will not ever vote for him again. He’s disaster to people on Social Security and only cares about his rich friends. The only thing he has done for us seniors is try to bankrupt us. I would love to see him live on less than 2,000 dollars a month. I’m sure he spends more than that every day. I am a lifelong republican. But I plan to vote against every single one of them that align with him.
