The US Occupational Health and Safety Administration (OSHA) announced that it is withdrawing its COVID vaccine mandate for employees. Earlier this month, the US Supreme Court struck down the ruling, saying that the agency doesn’t have the power to do so.

However, OSHA insisted it will continue efforts to revive the measure in the future.

In a statement Tuesday, the agency said that they are withdrawing the COVID vaccine mandate for employees immediately. “The US Department of Labor’s Occupational Safety and Health Administration is withdrawing the vaccination and testing,” it said.

It aimed to protect unvaccinated employees of large employers with 100 or more employees from workplace exposure. The withdrawal goes full-scale by Wednesday the next day. The agency also insisted that employees should still seek testing and vaccination of workers from COVID. 

Even with the Supreme Court's rejection, OSHA said it won’t give up completely. It said it still plans to make the rule permanent in the future. 

It said that it will not stop with setting the emergency testing standard (ETS) as a rule. As a result, the agency will prioritize its resources “to focus on finalizing a permanent COVID-19 Healthcare Standard.”

OSHA Belligerence Drawing Fire From Conservatives

Expectedly, many find OSHA’s belligerence alarming. The First Liberty Institute, which represented three religious ministries to challenge the mandate, said OSHA is trying to skirt the ruling.

According to Institute president Kelly Shackleford, “The Supreme Court already made it clear”. The Supreme Court already ruled that President Joe Biden’s attempts to federalize the nation’s workforce is blatantly unconstitutional.” 

“OSHA needs to completely put an end to this dangerous government overreach. He said that they will continue to fight for the American people being forced to violate their faith.

In addition, the Supreme Court also clarified that the COVID vaccine mandate for healthcare workers remains in effect. As a result, OSHA intends to issue a final standard that will protect healthcare workers from COVID-19 hazards. 

6-3 Supreme Court Ruling Struck Down COVID Vaccine Mandate For Employees

The Supreme Court ruling finally laid to rest one of Biden’s most controversial measures designed to control the virus. 

The SC’s majority opined that even with OSHA’s power to regulate occupational hazards, they do not have broad powers. In fact, the SC did not give OSHA “the power to regulate public health more broadly.”
