Mississippi Will Ban Biological Men In Women’s Sports

The Mississippi House and Senate overwhelmingly voted to ban biological men from playing in women’s sports. The State House passed the Mississippi Fairness Act on Wednesday, 81-28. Afterward, the State Senate passed the vote as well 34-9. Now, the bill awaits Governor Tate Reeves’ signature to make it an official law in the state.

The Mississippi Fairness Act  

The Fairness Act reads in full as follows: 

“Interscholastic or intramural athletic teams or sports that are sponsored by a public primary or secondary school or any school that is a member of the Mississippi High School Activities Association or public institution of higher education or any higher education institution that is a member of the NCAA, NAIA or NJCCA shall be expressly designated as one of the following based on biological sex: (a)  “Males,” “men” or “boys”; (b)  “Females,” “women” or “girls”; or (c)  “Coed” or “mixed.” Athletic teams or sports designated for “females,” “women” or “girls” shall not be open to students of the male sex.

If disputed, a student may establish his or her sex by presenting a signed physician’s statement which shall indicate the student’s sex-based solely upon (a) The student’s internal and external reproductive anatomy; (b)  The student’s normal endogenously produced levels of testosterone; and (c)  An analysis of the student’s genetic makeup.”

In summary, women’s sports will only accept biological women to participate. As such, school sports organizations will need to designate their teams and sports as men, women, and mixed. In addition, all teams and sports designated as women or females shall only accept athletes of the female sex. Consequently, the bill aims to ban biological men who identify as women from participating in female sports.   

Response to Biden’s Controversial Executive Order

The bill aiming to ban biological men comes after a controversial Executive Order signed by President Joe Biden. Specifically, the EO mandated the allowing of biological men who identify themselves as women to compete in women’s sports. The order states in part:

“Every person should be treated with respect and dignity and should be able to live without fear, no matter who they are or whom they love. Children should be able to learn without worrying about whether they will be denied access to the restroom, the locker room, or school sports. Adults should be able to earn a living and pursue a vocation knowing that they will not be fired, demoted, or mistreated because of whom they go home to or because how they dress does not conform to sex-based stereotypes. People should be able to access healthcare and secure a roof over their heads without being subjected to sex discrimination.  All persons should receive equal treatment under the law, no matter their gender identity or sexual orientation.” 

Critics protested the order as it gave undue advantage to biological males who identify themselves as females. Meanwhile, other groups proposed moves to protect female-only sports from incursion. 

Unfair Physical Advantage

“If we do not move to protect female sports from biological males who have an unfair physiological advantage, we will eventually no longer have female sports,” Republican state Senator Angela Hill said after the bill’s passage. Meanwhile, ABC reported that more states are considering passing similar laws. This year, 25 states began considering such bills. This is 7 more states compared to 2020. 

Meanwhile, noted author and women’s rights activist Abigail Shrier also disagreed with the order. This “unilaterally eviscerate[d] women’s sports,” she wrote on Twitter. “Any educational institution that receives federal funding must admit biologically-male athletes to women’s teams, women’s scholarships, etc,” she tweeted. In addition, Shrier lamented that a “new glass ceiling” now hangs over girls. 

Trump Slams Biden EO During CPAC Speech 

Last week, former President Donald Trump slammed Biden and the Democrats during his CPAC speech. Specifically, he said Biden stopped protecting women’s sports. “Joe Biden and the Democrats are even pushing policies that would destroy women’s sports,” he remarked. He said that young women now have to compete against biological males. This development is neither good for women or women's sports. He cautioned that women's sports records that stood for so long can now fall to biological men with ease. “If this is not changed, women’s sports, as we know it, will die, they’ll end, it’ll end,” Trump added.
