The Department of Justice has opened a grand jury investigation into whether former officials of former President Barack Obama manipulated intelligence tying Donald Trump to Russian interference in the 2016 election. U.S. Attorney General Pam Bondi ordered the probe after Director of National Intelligence Tulsi Gabbard released documents she claims reveal political weaponization of the intelligence community. A source familiar with the matter said federal prosecutors have been directed to present evidence to a grand jury, which could weigh criminal charges against the Obama administration officials. Gabbard’s declassified material forms the basis of the DOJ’s inquiry. Trump, now in his second term, has used the allegations to renew attacks on his predecessor. A spokesperson for former President Obama has dismissed the accusations as “bizarre” and politically motivated.
How Tulsi Gabbard’s Claims Took Center Stage
In July, Gabbard accused high-ranking intelligence officials from the Obama administration of politicizing their assessment of Russian interference. She alleged that the intelligence findings were distorted to portray Trump as a Russian asset and undermine his 2016 campaign. Gabbard said the documents she declassified reveal internal coordination to discredit Trump.
However, the January 2017 U.S. intelligence report concluded that Russia did attempt to interfere in the election through hacking, bot networks, and misinformation, with the goal of harming Hillary Clinton and boosting Trump. It found no evidence that Russia altered vote tallies or changed the election outcome.
Senator Marco Rubio, who led the Senate Intelligence Committee’s bipartisan investigation, affirmed the credibility of the 2017 assessment. That committee’s 2020 report found that Russia clearly favored Trump and that Obama-era officials responded appropriately to the threat. The report did criticize aspects of the FBI’s handling of its probe but did not support Gabbard’s broader claims of political conspiracy.
What a Grand Jury Investigation Could Mean
If prosecutors present sufficient evidence, the grand jury could recommend criminal charges against Obama administration officials who served under Obama. Former CIA Director John Brennan and former FBI Director James Comey are among those reportedly under scrutiny. Both have denied any wrongdoing and maintain that their actions were lawful and rooted in national security obligations. The formation of a grand jury allows prosecutors to issue subpoenas and compel testimony under oath. While no charges have been filed, the investigation marks a significant escalation in the long-running debate over the origins of the Russia probe. It is also the first time that former federal officials from a prior administration could face legal consequences over how they handled intelligence.
Special Counsel John Durham’s 2023 report previously criticized the FBI’s reliance on unverified sources in its initial probe but found no evidence of an organized conspiracy. Durham stated that the bureau lacked “analytical rigor” but stopped short of recommending charges against senior officials. He also acknowledged that political smear campaigns, while ethically questionable, are not inherently illegal.
If the grand jury declines to indict, the political ramifications could still be substantial. The DOJ’s move has energized conservative efforts to reform the intelligence community and revive claims that Trump was unfairly targeted. Democrats argue that the investigation misuses legal tools to re-litigate settled conclusions and discredit career officials without cause.
As of now, the Justice Department has not commented further, and the White House has issued no public statement.
