Donald Trump has launched a formal investigation into former President Joe Biden, accusing former aides of deceiving the public about Biden’s mental state during his presidency. At the heart of the inquiry is the use of an autopen, a writing device that replicates a president’s signature. Trump now claims it was used to mask Biden’s alleged cognitive decline and allow unauthorized staff to execute federal decisions.
Trump called the situation “one of the most dangerous and concerning scandals in American history.” He argued that key actions, including mass pardons and judicial appointments, may have been made without Biden’s knowledge or consent.
A Legal and Political Flashpoint
The memorandum issued by the Trump White House on Wednesday directed the Justice Department and the Presidential Counsel to determine whether Biden’s advisors used mechanical signatures to exercise Article II powers without legal authority. It also instructed them to examine whether staff intentionally concealed Biden’s mental and physical condition from the public.
House Oversight Committee Chair James Comer has also capitalized on the situation to expand his probe into the matter. He requested testimony from top Biden-era officials such as former Chief of Staff Ron Klain and senior adviser Anita Dunn. Comer’s letters reference accounts that Biden suffered from fatigue, confusion, and declining comprehension during key moments of his term.
The subsequent investigation will examine over 1,200 presidential actions, including 235 judicial appointments and an unprecedented wave of federal pardons. One cited event was the commutation of death row sentences days before Christmas in 2024, which Trump claims were endorsed without genuine presidential review.
Biden Responds with Dismissal and Defiance
Joe Biden, now 82 and publicly battling advanced prostate cancer, responded swiftly. “Let me be clear: I made the decisions during my presidency,” Biden said in a prepared statement. He labeled the accusations “ridiculous and false” and claimed they were distractions designed to draw attention away from Trump’s efforts to extend tax breaks for the wealthy.
Despite Biden’s denials, this is not the first time the former president’s mental capacity has faced scrutiny. His failed re-election campaign in 2024 ended abruptly after a widely criticized performance during a debate with Trump. A recent book by journalists Jake Tapper and Alex Thompson claimed that aides discussed using a wheelchair for Biden during the final months of his campaign. Still, Biden insists he retained decision-making authority throughout his term. He denied any suggestion that staff acted on his behalf without his knowledge.
A Fractured Legacy under Review
At stake is the legitimacy of many actions taken during Joe Biden’s time in office. If the inquiry proves that staff knowingly used the autopen to sign off on major policies while concealing the president’s incapacity, this means some of those actions may be invalid.
Critics, however, say the probe is politically motivated. The autopen has been used by presidents of both parties, including Trump. The real issue, they argue, is not the use of the device but the suggestion of intent to defraud the American public.
Comer has not ruled out issuing subpoenas to compel cooperation if former Biden aides decline to speak. Hearings, if held, would likely draw intense public interest as both parties clash over the legal meaning of executive intent and fitness. As the investigation unfolds, questions persist.
